General Terms and Conditions

1. General

The following Terms and Conditions govern the use of the Services provided by the Company and reflect the entire agreement between the Company and the person who subscribes to the Company's services (hereinafter referred to for brevity as the "End User" or "Customer"). Additional terms and conditions posted on the Company's website are expressly incorporated into these Terms and Conditions (hereinafter referred to collectively for brevity as the "Terms").

The Company may, at its sole discretion, modify the Terms at any time, for example to comply with legislative changes or changes related to its services. Such changes or modifications shall be effective immediately for all Customers upon posting of the modified Terms on the Company's website. If the End User disagrees with the modified Terms, he/she must discontinue use of the Company's services.

By using the Company's services, the End User accepts its compliance with the Terms.

2. Services

The Company's services include, but are not limited to, digital and other services that the Company offers online through the End User's mobile service provider (hereinafter referred to as the "Provider"), such as, for example, text messages, audio and/or video files, games and/or other related services (hereinafter referred to as the "Content Services"). The above Content Services are offered by the Providers' network via Short Message Services ('SMS'), General Packet Radio Services ('GPRS') and/or Third Generation Services ('3G') or any other means.

The Company is constantly changing and improving its Services. Accordingly, it may add or remove functions or features and suspend or discontinue a Service altogether.

3. End User Rights and Obligations

User - means an adult person, who uses the Service in accordance with the Terms and Conditions. Persons with limited legal capacity may use the Service provided that a legal representative of such person consents to such use, and persons without legal capacity - provided that their legal representative acts on their behalf.

The End User is granted permission to receive, store and display the Company's Content Services. The above license is personal, non-exclusive, non-assignable and is granted for the sole purpose of facilitating the End User's use and enjoyment of the benefits of the Services, as provided by the Company and in a manner permitted by the Terms.

While using the Services, the End User may receive service announcements, administrative messages and other information and has the right to choose to opt out of these communications.

4. Charges

By using the Company's Services, the Customer accepts the Company's charges as stated on its website. The Charges may vary depending on the Services provided, namely (a) subscription to the Content Services, (b) free units for downloading files ("Club Service") and (c) individual orders.

Charges for fixed subscriptions will be invoiced through the Customer's Provider account. Charges for prepaid subscriptions will be deducted from the Customer's credit balance.

The subscription service charge is €2.29 per SMS (12 SMS per month) or €0.57 per SMS (48 SMS per month) (including VAT), which will be received from the 5-digit code 54003 or 54099 respectively. Final Message Price.

All text messages sent by the Customer will be charged to them through their Provider, in accordance with standard charges. Such charges may vary per Provider.

5. Warranties and Disclaimers

The Company provides its Services using a commercially reasonable level of skill and care. However, the Company makes no specific commitments regarding the Services, such as, for example, regarding the content in the Services, the specific functions of the Services or their reliability, availability or ability to meet the needs of the End User. The Company provides its Services "as is".

6. Responsibility

The Company is not liable for any damages that the End User may suffer in relation to the Services. In any event, for any claim related to the Terms, including any implied warranties, the Company's total liability is limited to the amount that the End User paid to the Company for the Services.

9. Intellectual Property

Intellectual Property rights, such as trademarks, trade names, copyrights, database rights, registered designs, patents and any other similar rights protected in any country, as well as pending patent applications, related to the Company's Services and/or its website always remain the property of the Company.

10. Data Processing

The Company collects and uses certain personal data about the End User for commercial purposes. The Company will use such data in the manner described in its Privacy Policy, a copy of which is available on the Company's website, and in accordance with the legislation on the protection of personal data (General Data Protection Regulation (EU) 2016/679 (GDPR)).

By using the Company's Services, the End User consents to the aforementioned processing, reserving the right to object to this processing by sending an email to mobimilia.gr@cchelp.co

13. Applicable Law and Jurisdiction

The Terms will be governed by Greek Law and any dispute arising regarding their interpretation and/or application and/or termination will be referred to the Courts of Athens, which will decide on it with exclusive jurisdiction.
